Report: Eagle takes legal action against Home Depot over alleged parking space violation

BoiseDev is reporting the City of Eagle is taking legal action against Home Depot over the number of parking spaces the retail giant utilizes for sales items.

The city filed a complaint with the Ada County Fourth District alleging Home Depot is grossly over the 44 parking lot spaces city code allows for display items, according to BoiseDev.

In the filing, the city says the continued non-compliance by Home Depot "will cause the city irreparable harm to which there is no adequate legal remedy."

The city claims to have surveyed the parking lot, determined the spaces used were far more than the number allotted by city code and sent demand letters to Home Depot on multiple occasions.

Home Depot filed a response, saying the city's complaint fails to state a claim, says BoiseDev. "There is no actual controversy between the parties," claims Home Depot. The city's complaint states staff met with Home Depot's District Manager Trevor Cantwell in June last year, where he made assurances that they would follow up to resolve the issues."

Eagle says they sent a "final demand notice" to Home Depot and gave the store until April 7, 2023, to remedy the situation, or they would take legal action, says BoiseDev. City Staff then viewed the parking lot "one last time" before filing the lawsuit.
